1. Acceptance of Terms

By accessing or using Waterlands ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Waterlands provides live river condition monitoring, flow data, and related tools for anglers and water enthusiasts. We source data from public agencies including USGS and NOAA. We do not guarantee the accuracy, completeness, or timeliness of this data.

3. User Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years old to use the Service
  • One person may not maintain more than one account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity
  • Use the Service to send spam or unsolicited messages

5. Intellectual Property

Waterlands owns the Service, its design, code, and branding. River data from public agencies remains in the public domain. User-generated content (spots, fishing logs, community posts) remains owned by the user, but you grant Waterlands a license to display it within the Service.

6. Paid Features

Some features may require a paid subscription. Stripe processes payments. We will communicate refund policies at the time of purchase. We reserve the right to change pricing with reasonable notice.

7. SMS Alerts

Waterlands offers an optional SMS alert program. By providing your mobile number and giving express consent in your notification settings, you agree to receive automated text messages from Waterlands: a one-time verification code, and notifications for alerts you configure yourself.

Message frequency varies based on the alerts you create. Message and data rates may apply. Reply HELP for help or STOP to cancel at any time; you may also disable SMS or remove your number in your notification settings. Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not a condition of using Waterlands or of any purchase. Full program details are on our SMS Alerts page, and our handling of your number is described in our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. River conditions are inherently dangerous and unpredictable. Waterlands does not guarantee the accuracy of flow data, conditions, or safety ratings. Always exercise independent judgment and caution when on or near water.

9. Limitation of Liability

Waterlands shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. This includes, but is not limited to, personal injury, property damage, or loss of data. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time through your account settings.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will email registered users about material changes.

12. Governing Law

These terms are governed by the laws of the State of Colorado, United States.
